Your Next Store License

This License Agreement ("Agreement") is entered into between Your Next Store, represented by Michał Miszczyszyn, Type of Web - Michał Miszczyszyn, ul. Stolema 6H/2, 80-177 Gdańsk, Poland; VAT ID PL6040080451; hi@yournextstore.com, and you, the user ("Licensee"), regarding the use of the Your Next Store product (the "Product") available at https://yournextstore.com.

By downloading, accessing, or using the Product, the Licensee agrees to be bound by the terms and conditions of this Agreement.

1. Grant of License

1.1 Personal License

Subject to the terms and conditions of this Agreement, Your Next Store grants the Licensee a personal, non-exclusive, non-transferable, and non-sublicensable license to use the Your Next Store product for personal or commercial purposes. This license is granted solely to the individual Licensee.

Personal License Permissions:

• Create unlimited End Products for personal or commercial use.
• Modify the codebase and design to create derivative works. These derivative works are subject to the same license terms as the original Your Next Store product.

Personal License Restrictions:

• Prohibited from redistributing Your Next Store or its derivatives separately from an End Product.
• Prohibited from sharing access to Your Next Store with other individuals.
• Prohibited from creating products that facilitate End Users in building their projects using Your Next Store code or design assets.
• Prohibited from using Your Next Store to develop products competitive with Your Next Store.

1.2 Team License

Subject to the terms and conditions of this Agreement, Your Next Store grants the Licensee a team-based, non-exclusive, non-transferable, and non-sublicensable license to use the Your Next Store product. This license is granted to the business entity Licensee.

Team License Permissions:

• Use Your Next Store collaboratively within the Licensee's team to create unlimited End Products for personal or commercial use.
• Modify the codebase and design to create derivative works. These derivative works are subject to the same license terms as the original Your Next Store product.

Team License Restrictions:

• Prohibited from redistributing Your Next Store or its derivatives separately from an End Product.
• Prohibited from sharing access to Your Next Store with individuals outside the Licensee's team.
• Prohibited from creating products that facilitate End Users in building their projects using Your Next Store code or design assets.
• Prohibited from using Your Next Store to develop products competitive with Your Next Store.

2. Ownership and Intellectual Property

Your Next Store retains all ownership and intellectual property rights in and to the Your Next Store product. This Agreement does not grant Licensee any ownership rights in the Your Next Store product.

3. Warranty and Disclaimer

THE YOUR NEXT STORE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR NEXT STORE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE YOUR NEXT STORE PRODUCT, EVEN IF YOUR NEXT STORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Gdańsk, Poland.

6. Entire Agreement

This Agreement constitutes the entire Agreement between Licensee and Your Next Store concerning the subject matter. It supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.
